Terms and Conditions

These terms form an agreement between you and Ride with Tom - Tomislav Marcenic, Oberhofen 1, 6034 Inwil, Switzerland ("we", "us"). Contact: ridewithtomch@gmail.com. The service covers the ridewithtom.ch website, the K3P training modules, the WhisperAI assistant, and in-person and online coaching.

1. Acceptance

By using the site, creating an account or purchasing a subscription you confirm that you have read and accept these terms. If you do not agree, do not use the service.

You must be of legal age or have parental consent. If you register on behalf of an organisation, you confirm you have authority to bind it.

2. Your account

You are responsible for keeping your credentials confidential and for all activity under your account.

Information you provide must be accurate and kept up to date.

3. Acceptable use

You must not: use the service unlawfully, commit fraud or send spam, infringe intellectual property rights, interfere with security (malware, probing, scraping), share your account access with third parties, or resell or publish K3P video and written materials.

4. Intellectual property and licence

All content — videos, texts, photographs, the K3P methodology, software and branding — remains our property.

For the duration of your subscription you receive a limited, non-exclusive, non-transferable right to access the content for your own non-commercial use. Downloading, copying, redistribution and reverse engineering are prohibited.

5. Service level and AI-generated content

We do not guarantee uninterrupted or error-free operation; planned and unplanned maintenance may occur.

WhisperAI is an AI assistant and its answers may be inaccurate or incomplete. Answers are informational and do not replace veterinary care or hands-on coaching. You remain responsible for your actions around horses and for assessing safety. Working with horses carries a risk of injury.

You are responsible for the content you submit to the assistant and confirm you hold the rights to it.

6. Payment, subscriptions and taxes

Subscriptions are billed monthly in advance at the prices shown on the pricing page.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

You may cancel at any time; access remains active until the end of the paid period.

7. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations.

After access ends, your personal data is deleted or anonymised in line with our Privacy Notice.

8. Liability

To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.

Our aggregate liability is capped at the fees you paid in the preceding 12 months. We exclude indirect and consequential damages (lost profits, data, goodwill). These limits do not apply to fraud, death or personal injury.

9. Governing law

Swiss law applies, with the courts of the Canton of Lucerne having jurisdiction, without affecting mandatory consumer protection rules.
